Terms of Service

1. Acceptance of Terms

By creating an account or using GedCom ReportWriter AI (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and JavaBeanAI ("Company," "we," "us," or "our"). We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older. If we learn that an account has been created by someone under 18, we will terminate that account and delete all associated data.

3. Account Registration

To use the Service, you must create an account using our authentication provider (Clerk). You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and current information during registration

4. Permitted Use and Acceptable Use Policy

The Service is designed for personal and professional genealogical research and report generation. You may use the Service to:

• Upload and organize your own family tree data (GEDCOM files)
• Generate reports, biographies, and charts for your personal or professional genealogical research
• Share reports with family members
• Use AI features to enhance and annotate your genealogical records

You may NOT use the Service to:

• Upload GEDCOM files or data you do not have the right to use
• Commercially resell, redistribute, or sublicense the personal data of others contained in your GEDCOM files
• Upload content that infringes the intellectual property rights of others
• Upload content that is unlawful, defamatory, or harassing
• Attempt to access other users' data or circumvent security measures
• Use the Service for any purpose that violates applicable laws, including privacy laws
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools to scrape or bulk-download data from the Service beyond normal use

5. AI-Generated Content — Important Disclaimer

The Service uses artificial intelligence (xAI's Grok models) to generate biographical narratives, photo transcripts, data quality analyses, and other content based on your genealogical data. You acknowledge and agree that:

• AI content may be inaccurate. AI-generated biographies, transcripts, and analyses may contain errors, omissions, or fabricated details not present in your source GEDCOM data. In "Storytelling" mode, the AI may intentionally add creative or atmospheric details (e.g., weather, period context) that are illustrative rather than factual.
• AI content is not a historical record. AI-generated content must not be treated as a reliable genealogical source or primary historical record. You are solely responsible for verifying any AI-generated content against primary sources before sharing or publishing it.
• You own AI-generated content. Content generated by the AI at your request, based on your data, is yours. However, we do not warrant its accuracy.
• Review before sharing. You should review all AI-generated content before including it in reports, sharing with others, or submitting to genealogical archives or publications.
• Living persons. The AI may generate content about living individuals based on data in your GEDCOM file. You are responsible for ensuring such use complies with applicable privacy laws.

We expressly disclaim all liability for any inaccuracies, errors, or omissions in AI-generated content.

6. Beta Service

During the beta period, you acknowledge and accept that:

• The Service may be interrupted, unavailable, or behave unexpectedly
• Features may be added, changed, or removed without notice
• While it is our strong intention to preserve your data through the beta period and into general availability, we cannot provide an absolute guarantee against data loss
• We strongly recommend you retain your own copies of all uploaded files and generated PDFs
• Pricing, if any, may change when the Service exits beta

7. Your Content and Intellectual Property

Your Data

You retain all ownership rights to the GEDCOM files, photographs, and other data you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited license to process, store, and display Your Content solely for the purpose of providing the Service to you.

Our Intellectual Property

The Service, including its software, design, branding, and AI infrastructure (excluding Your Content), is owned by JavaBeanAI and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from our Service without our written permission.

Feedback

If you submit feedback, bug reports, or feature suggestions to us, you grant us the right to use that feedback to improve the Service without any obligation to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data practices.

9. DMCA and Copyright

We respect intellectual property rights and expect our users to do the same. If you believe that content on the Service infringes your copyright, please send a written notice to support.gedcom@javabeanai.com including:

• A description of the copyrighted work you believe has been infringed
• The location of the allegedly infringing content on the Service
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your electronic or physical signature

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content. This disclaimer applies with particular force during the beta period.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAVABEANAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Termination

You may terminate your account at any time by using the account deletion feature in the Settings page. Upon termination, your data will be deleted as described in our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, if we discontinue the Service, or for any other reason with reasonable notice where practicable. If we terminate your account for a reason other than violation of these Terms, we will give you reasonable opportunity to export your data.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which JavaBeanAI operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or, where arbitration is not available, in the courts of that jurisdiction. 14. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will update the version number and date at the top of this page and, where appropriate, notify you by email or require re-acceptance within the app. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
